Terms of Service

Welcome to Hema Stone Jewellery! The terms “we”, “us” and “our” refer to Hema Stone Jewellery. Hema Stone Jewellery operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Hema Stone Jewellery is powered by Shopify, which enables us to provide the Services to you. 

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Section 2 - Access and Eligibility

By using the Services, you confirm that you are at least 18, or are using the Services with the consent of a parent or guardian who takes responsibility for your use of it. To place an order, you may be asked for information such as your email, billing, payment and shipping details. You confirm that any information you give us is accurate, current and complete.

Section 3 - Our Products

We make every effort to accurately describe and picture our products, but actual colour may vary slightly depending on your screen and device settings. Product descriptions are subject to change, and we may discontinue or limit the quantity of any product at our discretion, though this does not affect orders you've already placed.

Section 4 - Orders

Placing an order is an offer to buy. A contract is formed when we send you an order confirmation email; we may decline or cancel an order before then (for example, due to a stock, pricing, or listing error, or suspected fraud) - if we do, we'll tell you and refund any payment already taken in full. This right to decline an order does not limit your separate cancellation right in Section 6 below.

Section 5 - Prices and Payment

Prices are shown in GBP and include VAT where applicable. Delivery charges and any surcharges (for example for Northern Ireland, the Scottish Highlands & Islands, the Isle of Man, the Isle of Wight, or the Channel Islands) are shown before you complete payment, in line with our Shipping Policy. You confirm that your payment details are accurate and that you're authorised to use the payment method provided.

Section 6 - Your Right to Cancel (Cooling-Off Period)

Under the Consumer Contracts Regulations 2013, you can cancel your order for any reason within 14 days of receiving your goods, without needing to give a reason. To cancel, contact us at help@hemastonejewellery.co.uk with a clear statement that you wish to cancel (including your order number). You must then return the goods within 14 days of telling us, at your own cost unless the item is faulty, damaged, or incorrect. We'll refund you, including standard delivery charges, within 14 days of receiving the goods back or of you providing proof of postage, whichever is sooner.

This right does not apply to goods made to your specification or clearly personalised, except where they are faulty, damaged, or incorrect — see Section 7.

Section 7 - Faulty, Damaged or Misdescribed Goods

Separately from Section 6, if your goods are faulty, damaged, not as described, or not fit for purpose, you have statutory rights under the Consumer Rights Act 2015: a full refund within 30 days of delivery; repair or replacement (our choice) between 30 days and 6 months, with a refund or price reduction if that doesn't resolve things; and the same remedies after 6 months, where we may ask for evidence the fault was present at delivery. This applies to personalised items too. Contact help@hemastonejewellery.co.uk with your order details and, where possible, photos of the issue.

Section 8 - Delivery

We aim to deliver in line with the timescales in our Shipping Policy. Risk of loss or damage to your order stays with us until the goods come into your physical possession (or that of someone you've nominated to receive them), unless you've arranged collection through your own courier that we didn't offer you. Ownership of the goods passes to you once we've received payment in full.

Section 9 - Intellectual Property

The Services - including text, images, graphics, logos, and their design and arrangement - belong to Hema Stone Jewellery or our licensors and are protected by UK and international copyright, trade mark and other intellectual property laws. You may use the Services for your own personal, non-commercial use only, and must not reproduce, copy, resell, or create derivative works from any part of them without our written consent.

Section 10 - Optional Third-Party Tools and Links

The Services may link to, or give you access to, tools or websites operated by third parties that we don't control. These are provided "as is," without endorsement, and any use of them is at your own risk - this doesn't affect your statutory rights in relation to goods you buy directly from us.

Section 11 - Feedback

If you send us feedback, reviews, or suggestions, you give us a royalty-free, worldwide licence to use them to operate and improve the Services. You confirm that any feedback you give is honest and, where it relates to a product review, reflects your genuine experience - we don't publish, incentivise, or accept fake reviews, in line with the Digital Markets, Competition and Consumers Act 2024.

Section 12 - Prohibited Uses

You agree not to use the Services unlawfully, to infringe anyone's rights, to transmit false or misleading information, to send unsolicited advertising, to impersonate any person, or to interfere with the security or operation of the Services. We may suspend or close your account if you breach this section.

Section 13 - Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded - including your statutory rights under the Consumer Rights Act 2015.

Subject to that, we supply the Services for your personal, domestic use, and we are not liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity, since these do not apply to a domestic consumer. Our total liability to you for a claim relating to a product is limited to the price you paid for it.

Section 14 - Complaints and Alternative Dispute Resolution

If something's gone wrong, please contact us first at help@hemastonejewellery.co.uk so we can put it right.

Section 15 - Indemnity

You agree to cover any losses, damages, or reasonable costs we incur as a result of your breach of these Terms or your misuse of the Services, except where caused by our own breach or negligence.

Section 16 - Severability, Waiver, Assignment

If any part of these Terms is found unenforceable, the rest continues to apply. Our failure to enforce a right doesn't waive it. You may not transfer your rights under these Terms without our consent; we may transfer ours, for example if the business is sold, without affecting your statutory rights.

Section 17 - Changes to These Terms

We may update these Terms from time to time; the version in force when you placed your order applies to that order. The current version is always available on this page.

Section 18 - Governing Law and Jurisdiction

These Terms are governed by the law of England and Wales. Any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales - if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts. This does not affect your right to rely on mandatory consumer protections in the country where you live.
